Alina Habba has left her position as New Jersey's top federal prosecutor. This follows a judicial decision that invalidated her legal standing to hold the office.
US Attorney General, Pam Bondi, announced the prosecutor's departure on the start of the week. She commented that the appeals court finding made it "untenable" for Habba to effectively run her office.
"But do not mistake adherence to the ruling as defeat," she declared. "My fight will now stretch across America."
Her resignation follows closely on a federal appellate panel ruled that she had been serving in violation of the law as the top prosecutor. This judgment is expected to impact numerous legal proceedings in the Garden State.
The appellate judges ruled that a acting appointment that skirted confirmation by the US Senate violated the statute on vacant positions.
It was also stated that Habba will continue working within the justice department as a top consultant. She will pursue additional appeals of the disqualification, aiming for a overturned decision.
On a social media platform, the Attorney General wrote that the judiciary "must not second-guess the President's choice of lawyers entrusted with executing the executive branch's core responsibility of enforcing the law."
The attorney general highlighted Habba's record and noted that during her run, the Newark saw a 20% reduction in criminal activity. It was also reported that the southern city of Camden recorded its first summer in half a century with no murders.
The 41-year-old attorney, first joined Donald Trump's lawyers in recent years. She went on to defended her client in his business records case in New York last year, leading to his conviction on multiple felony counts of falsifying business records.
Prior to Habba took on the role of US Attorney, the former president had stated he was naming her as his White House advisor in a potential future term, calling Habba as "unwavering in her loyalty" and a "tireless advocate for justice".
