A court has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his continued detainment is without lawful basis.
"Since his release after wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her ruling.
The situation originates in a mistaken deportation to El Salvador in March, which US authorities later acknowledged was an mistake. Following his repatriation to the United States to answer alien smuggling allegations, he was held in immigration custody.
In her order, the court noted that the authorities lacks a valid deportation order, which prevents them from removing Mr. Abrego Garcia "at this juncture."
The legal challenge center on conflicting assertions. Whereas the Trump administration contends that Abrego Garcia is a member of the MS-13 gang, he vehemently disputes this allegation.
He has also pleaded not guilty to the conspiracy charges, which are part of a separate criminal case in Tennessee.
The court, who was hearing his challenge to deportation in a federal court, ruled that he must now comply with the terms of his release from jail in Tennessee. This decision shifts his supervision to the Tennessee court.
